Pepfolio Terms of Service

Welcome to Pepfolio.
These Terms of Service ("Terms") govern your access to and use of the Pepfolio mobile application, website at https://getpepfolio.com, and related services (collectively, the "Service").
Pepfolio is operated by Kevin Guisarde, an individual based in the United States ("Pepfolio," "we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to these Terms and acknowledge our Privacy Policy.
If you do not agree to these Terms, do not use the Service.
1. About Pepfolio
Pepfolio is a personal tracking and organization application designed to help adults manage information about their peptide routines.
The Service may allow you to:
- Add and organize peptides.
- Record personal routines, schedules, and reminders.
- Log activities and maintain historical records.
- Track measurements, goals, and personal progress.
- Create journal entries and record observations.
- Upload photographs and audio recordings.
- Export personal tracking information.
- Manage account settings and privacy preferences.
Features may change, be added, or be discontinued over time.
2. Not Medical Advice
Pepfolio is not a medical service, healthcare provider, pharmacy, or medical device.
The Service is intended solely for personal recordkeeping, organization, and tracking.
Pepfolio does not provide medical advice, diagnosis, treatment, prescriptions, or individualized medical recommendations.
Information displayed in the Service, including peptide names, schedules, amounts, strengths, progress records, and other tracking information, is provided for organizational purposes only.
The inclusion of a peptide in the application's catalog does not mean that Pepfolio recommends, endorses, or confirms the safety, legality, effectiveness, or regulatory approval of that substance.
Some substances listed or recorded in Pepfolio may be investigational, unapproved, or subject to legal restrictions.
Pepfolio does not recommend that you obtain, possess, administer, or use any particular substance.
You are responsible for consulting an appropriately qualified healthcare professional about medical questions, treatment decisions, potential risks, and the use of any substance.
Do not disregard professional medical advice or delay seeking medical attention because of information recorded or displayed in Pepfolio.
If you believe you are experiencing a medical emergency, seek emergency assistance immediately.
3. Eligibility
You must be at least 18 years old to create an account or use Pepfolio.
By registering, you confirm that:
- You are at least 18 years old.
- You have the legal capacity to agree to these Terms.
- You will use the Service in compliance with applicable laws.
- Information you provide during registration is accurate to the best of your knowledge.
We may suspend or terminate accounts that do not meet these requirements.
4. Your Account
You may need to create an account to access Pepfolio's features.
You agree to:
- Provide accurate account information.
- Maintain the confidentiality of your login credentials.
- Take reasonable precautions to protect your account and devices.
- Notify us if you suspect unauthorized account access.
- Avoid sharing your account credentials with others.
You are responsible for activity conducted through your account to the extent permitted by applicable law.
We may require email verification or other authentication steps to protect accounts and maintain the Service.
5. Personal Tracking Information
Pepfolio allows you to enter and organize information about your personal routines and activities.
You are responsible for the information you choose to record, including peptide names, strengths, amounts, units, schedules, and observations.
Pepfolio does not independently verify the accuracy, suitability, safety, or medical appropriateness of information you enter.
Recording an amount, strength, or schedule in Pepfolio does not constitute a recommendation or instruction from Pepfolio.
The Service may display information you previously entered to help organize your records. Such information should not be interpreted as medical guidance.
You are responsible for confirming the accuracy of your records and for making decisions about your own health with appropriate professional guidance.
6. Reminders and Notifications
Pepfolio may provide optional scheduling and reminder features.
Reminders are organizational tools only.
We do not guarantee that a reminder or notification will be delivered at a particular time or delivered at all.
Notification delivery may be affected by device settings, operating-system restrictions, battery conditions, connectivity, permissions, or other circumstances outside our control.
You should not rely on Pepfolio as your sole reminder system for medically necessary treatment or time-sensitive healthcare activities.
You are responsible for managing your schedules and any decisions or actions associated with them.
7. Journal Entries, Photos, Audio, and Other Content
You may create or upload content through the Service, including written entries, observations, photographs, audio recordings, and other personal information ("User Content").
You retain ownership of the User Content you create or submit, subject to any rights held by others.
You grant Pepfolio a limited, non-exclusive, worldwide license to host, store, process, reproduce, format, and display your User Content solely as reasonably necessary to operate, maintain, secure, and provide the Service and its requested features.
This license does not grant Pepfolio ownership of your User Content.
You represent that you have the necessary rights and permissions to submit any content you upload.
You agree not to upload content that:
- Violates applicable laws.
- Infringes another person's intellectual property or privacy rights.
- Contains malicious software or harmful code.
- Is intended to compromise the Service or another user's account.
- Is otherwise used to facilitate unlawful or abusive activity.
You are responsible for reviewing your content before saving or sharing it.
8. Privacy and Personal Information
Your use of Pepfolio is also governed by our Privacy Policy:

The Privacy Policy explains how we collect, use, disclose, store, and protect personal information.
Pepfolio may process sensitive health-related information that you choose to record.
You should avoid uploading information you do not wish to store through the Service.
Privacy and security protections are subject to the limitations described in the Privacy Policy.
9. Data Export and Account Deletion
Pepfolio provides features that allow you to manage, export, and delete supported account information.
You may request an export of your information through the available account settings.
Exports may contain sensitive personal information, including photographs, audio recordings, and tracking records.
You are responsible for protecting downloaded files and deciding whether to store or share them.
You may also request account deletion through the application.
Account deletion removes associated application records and initiates cleanup of private media. Certain information may remain temporarily in backups, logs, service-provider systems, or other records where retention is necessary or permitted by applicable law.
Once an account has been deleted, access to its associated information may not be recoverable.
We recommend exporting information you wish to retain before requesting deletion.

10. Subscriptions and Paid Features
Pepfolio may offer optional paid subscriptions or premium features.
When a paid offering is available, the applicable purchase interface will disclose its price, billing frequency, included features, and other material purchase terms before you complete a purchase.
If subscriptions are offered through Apple App Store, Google Play, or another authorized payment provider, payment processing and subscription management may be subject to that provider's terms.
For automatically renewing subscriptions, applicable purchase disclosures will explain renewal and cancellation terms.
Unless otherwise stated at purchase, deleting the Pepfolio app or your Pepfolio account does not necessarily cancel a subscription managed through an external payment provider.
We will not charge subscription fees unless you authorize a purchase through an available payment flow.
10.1. Refunds & Cancellations
For purchases through the Apple App Store, request a refund through Apple’s refund process. Refund requests are handled by Apple under its applicable policies.
For purchases through Google Play, refunds follow Google Play’s refund policies. You may also contact Pepfolio Support through Settings → Help & Feedback where applicable.
Canceling a subscription prevents future renewals but does not automatically refund previous charges. Manage or cancel your subscription through the store where you purchased it.
After cancellation, paid access generally continues through the remainder of the current billing period, unless a refund or revocation changes your entitlement.
Nothing in this policy limits or excludes applicable consumer rights, including any refund rights protected by applicable law.
11. Acceptable Use
You agree not to:
- Use Pepfolio for unlawful purposes.
- Attempt to access another user's account or private information.
- Circumvent authentication or security controls.
- Interfere with the Service's infrastructure or operation.
- Introduce malware or harmful software.
- Reverse engineer or misuse the Service in violation of applicable law.
- Use automated methods to overload, scrape, or disrupt the Service without authorization.
- Misrepresent your identity or impersonate another person.
- Use Pepfolio to facilitate the unlawful sale or distribution of regulated substances.
We may investigate suspected violations and take reasonable action to protect the Service and its users.
12. Intellectual Property
Pepfolio, including its name, branding, software, interface designs, original content, and other proprietary materials, is owned by Pepfolio's operator or applicable licensors.
These Terms do not transfer ownership of Pepfolio's intellectual property to you.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purposes, subject to these Terms.
You may not copy, distribute, sell, sublicense, or commercially exploit protected portions of the Service without authorization, except as permitted by applicable law.
Your ownership of User Content is addressed separately in Section 7.
13. Third-Party Services
Pepfolio relies on third-party technologies and service providers for certain functionality, such as authentication, infrastructure, storage, and email delivery.
Your use of certain features may also be subject to the terms and privacy policies of relevant third-party providers.
We are not responsible for independent third-party services or websites that we do not control, except as required by applicable law.
14. Service Availability and Changes
We aim to provide a reliable and useful Service, but uninterrupted availability cannot be guaranteed.
Pepfolio may experience temporary interruptions, maintenance, software errors, connectivity problems, or changes in third-party services.
We may modify, improve, suspend, or discontinue features.
Where required by applicable law, we will provide notice of material changes affecting users' rights or paid services.
We do not guarantee that every feature will remain available indefinitely.
15. Suspension and Termination
You may stop using Pepfolio at any time and may request account deletion through available settings.
We may suspend or terminate access when reasonably necessary to:
- Address violations of these Terms.
- Prevent fraud or unauthorized access.
- Protect the security or integrity of the Service.
- Comply with applicable law.
- Respond to significant misuse or abuse.
Where appropriate and legally permitted, we may provide notice or an opportunity to resolve an issue.
Termination does not eliminate obligations or rights that, by their nature, should survive termination.
16. Disclaimers
TO THE EXTENT PERMITTED BY APPLICABLE LAW, PEPFOLIO IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
We do not warrant that the Service will be uninterrupted, error-free, completely secure, or suitable for a particular medical or personal purpose.
We do not warrant the accuracy or completeness of user-entered information or third-party information displayed through the Service.
Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Pepfolio and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Service.
This includes, where legally permitted, losses resulting from service interruptions, missed reminders, inaccurate user-entered information, or unauthorized access beyond our reasonable control.
Nothing in these Terms limits liability that cannot legally be limited, including liability arising from conduct for which applicable law prohibits such limitations.
18. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Pepfolio and its operator from third-party claims, damages, and reasonable expenses arising from your unlawful use of the Service, your infringement of another person's rights, or your material violation of these Terms.
This obligation does not apply to the extent a claim results from Pepfolio's own unlawful conduct or other circumstances for which indemnification is prohibited by law.
19. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law principles, except where applicable consumer protection laws require otherwise.
Any disputes arising from these Terms or the Service will be resolved in courts with appropriate jurisdiction, subject to applicable law and any mandatory consumer protections.
Nothing in this section prevents you from exercising rights or remedies that cannot be waived under applicable law.
20. Changes to These Terms
We may update these Terms to reflect changes in the Service, applicable laws, or business practices.
When changes are made, we will update the Last updated date above.
Where required by law, we will provide additional notice or request your agreement to material changes.
Your continued use of the Service after updated Terms become effective may constitute acceptance where permitted by law.
